 Introduction

 

These conditions of sale are concluded by and between, the company Alterna Management sprl whose registered office is at street Ry d'Hez, 22-1470 Baisy-Thy, registered with the Crossroads Bank for Enterprises under number 0475 693 740 hereinafter referred to as "seller" and, secondly, by any natural or legal person wishing to make a purchase via the website of the seller, hereinafter "buyer".

These conditions of sale define the contractual relationship between the seller and the buyer and the conditions applicable to all purchases made through the website of the seller, the buyer being a professional or a consumer. 

The acquisition of goods or services through this site implies the acceptance by the buyer of these conditions of sale.  These conditions shall prevail over any other general or special conditions not specifically approved by the seller.  The seller reserves the right to modify terms and conditions at any time. In this case, the conditions will be those in force at the date of the order by the buyer.

 

Characteristics of goods and services

 

The products and services offered are those listed in the catalog published on the vendor website.  Each product is accompanied by a description provided by the seller.  Taking into account the fact that most products are handcrafted, picturess in the catalog are as accurate as possible but can not ensure a perfect similarity with the product, especially as regards to colors. These products and services are offered within the limits of available stocks. If, despite his efforts, some or all of the items are unavailable, the seller shall inform the buyer by email as soon as possible and offer him the possibility to choose between wait or cancel the order of unavailable item for free.  Available items will be delivered normally.

 

Rates

 

The prices of products and services displayed on the Site are quoted in euros all taxes included (VAT and other applicable taxes).  The seller reserves the right to modify its prices at any time. However, the prices for an order are those in effect at the time of order confirmation.  Prices shown do not include the cost of transportation and delivery if they take place in the geographical areas set out below.

 

Locations

 

The online sale of products and services presented on the vendor website is for buyers living in Belgium, France, the Grand Duchy of Luxembourg or the Netherlands and for shipping required in these areas.

 

Orders

 

The buyer, who wishes to buy a product or service must:

- fill in the identification form or giving its customer number if any

-  fill in the online order form giving all references to products or services;

- validate the order after reviewing it;

- make payment as provided;

The confirmation of the order implies acceptance of these terms and conditions, the recognition of having perfect knowledge of it, and waiver of its own conditions of purchase or other conditions.  All data recorded and confirmed will be considered as a valid proof of the transaction.  Confirmation worth signing and acceptance of transactions. The seller will email confirmation of the order recorded.

 

Right of withdrawal

 

According to the law, the consumer has the right to notify the seller that he cancels the purchase, without penalty and without giving any reason, within 14 working days from the day after delivery of the product or the conclusion of the service contract. This right of cancellation is not applicable to the professional buyer.  Within this period, the consumer must notify his intention to surrender by e-mail and return, at its expense and risk, the product delivered to the headquarters of Madame Framboise :

Products must be returned in their original packaging, undamaged, with all their accessories and the orignal invoice or delivery note.  The products being returned must not have been unwrapped, unsealed or used in any way.  Incomplete goods, damaged or soiled by the customer will not be taken back.  Within 30 days after acceptance of the return of the goods, the seller agrees to pay the contingent payment, excluding shipping.  Unless otherwise agreed, the consumer may not exercise the right of withdrawal for contracts:

1° provision of services if performance has begun with the consumer's agreement before the end of the withdrawal period.

2° supply of products made according to the consumer's specifications or clearly personalized or which, by their nature, can not be returned or are liable to deteriorate or expire rapidly.

 

Payment terms

 

Ordered items remain our sole property until full payment of the order by the buyer.  Payments can be made by two systems, in Euro, via PayPal or  by bank transfer within 10 days on account BE86 8508 1926 7250 indicating your order number.  Paypal payments will only be available from a minimum order amount (19.00 euros excluding transport).  Orders are shipped promptly after receipt of payment. Any order for which payment has not been made within 10 days is automatically canceled.  All additional costs that may be claimed by the buyer's bank for transactions to our account are entirely the responsibility of the buyer.

 

Deliveries

 

Deliveries are made to the address indicated on the order form which can only be in the area agreed.  The goods are transported at the risk of the seller until delivery of the goods to the delivery address specified by the buyer. From that time, the buyer assumes all the risks. Delivery times are for information purpose only; if they exceed thirty days from the order, the contract may be terminated and the buyer paid.

 

Warranty

 

With regard to consumers, the seller guarantees the products it sells and the services it provides in accordance with the law of 1 September 2004 on consumer protection in case of sale of consumer goods (Article 1649 bis cg 1649 of the Civil Code).  In case of non compliance of a product sold observed within 2 months of delivery of the goods, the consumer must notify the seller as soon as possible precisely by registered letter or email. This warranty only covers conformity defects existing at the time of delivery of the goods. Defects or damage from misuse, such as water, oxidation, fall or impact, neglect and wear damage are not covered by the warranty. Similarly, repair by unauthorized technicians by the supplier, will result in the cancellation of the warranty.  The invoice or packing slip serve as guarantee document and shall be retained and produced in their original version by the buyer.  If the product is used for purposes other than private, limited warranty conditions of the manufacturer / supplier becomes applicable.  

 

Responsability

 

The seller, in the process of selling online is only bound by an obligation of means; its responsibility can not be held liable for damages resulting from the use of the Internet such as data loss, hacking, viruses, break service, or other unintended problems.  The data shown on the site are also given in good faith. The links to the websites of manufacturers and / or partners are given for information only. The seller can not be held responsible for information from these sites.

 

Intellectual property

 

All elements of the vendor website are and remain the exclusive intellectual property of it. Nobody is allowed to reproduce, use, repost, or use for any purpose whatsoever, even partially, the elements of the site, whatever their nature (softtware, visual, sound ...).  Any single link or hyperlink is strictly prohibited without the express prior written agreement of the vendor.

 

Personal data

 

TAll personal data necessary to process an order are retained by the seller or its employees and can be transmitted to companies with whom the vendor - or vendors - works (s) where such disclosure is necessary for the treatment of order.  The user also authorizes the seller to also use these data to compile statistics in order to improve its website, the goods and services it offers.  This information may also be used to enable the dissemination by any means of communication, information relating to the seller's customer business.  Finally, the seller retains personal data to facilitate future orders. For the rest, the seller agrees not to disclose the information available to another company or another company. Data kept by the seller may at any time be requested and corrected on request.

 

Evidence

 

The parties agree, in the context of their relations, electronic evidence (by way of example: email, computer backups, ...).

 

Settlement of disputes

 

These conditions of online sales are subject to Belgian law.  In case of dispute, the courts of the head office of the seller are competent (Tribunal de Commerce de Nivelles), except public order provisions binding.
